Cookeaz is a SaaS (Software as a Service) cookie consent management platform enabling website owners to comply with applicable regulations (GDPR, ePrivacy, CCPA, LGPD, etc.).

5.2 Service Access

Access to the service requires creating a user account. The user agrees to provide accurate information and maintain the confidentiality of their login credentials.

The user is solely responsible for the use of their account and any consequences that may result.

5.3 User Obligations

The user agrees to:

• Use the service in accordance with its intended purpose
• Not use the service for illegal or fraudulent purposes
• Not attempt to compromise the security of the service
• Respect the intellectual property rights of Cookeaz and εkto γamat SAS
• Ensure that widget usage complies with regulations applicable to their activity

5.4 Service Availability

Cookeaz strives to ensure optimal service availability. However, we do not guarantee 100% availability. Interruptions may occur for maintenance, updates, or force majeure.

For Pro and Business plans, we commit to a 99.9% monthly availability SLA.

6. Limitation of Liability

εkto γamat SAS endeavors to provide a quality service. However, our liability cannot be engaged in the following cases:

• Indirect damages (loss of revenue, data loss, reputation damage, etc.)
• Service interruption due to force majeure
• Non-compliant use of the widget by the user
• Actions by malicious third parties despite security measures in place
• Misconfiguration of the widget by the user

In any case, the liability of εkto γamat SAS is limited to the amounts paid by the user during the last 12 months.

7. Pricing and Payment Terms

7.1 Plans and Pricing

Cookeaz offers several subscription plans, details of which are available on our Pricing page. Prices are displayed in euros excluding taxes (HT) and including all taxes (TTC) depending on the user's country.

7.2 Billing

• Subscriptions are billed in advance, monthly or annually according to the user's choice
• Invoices are available in the customer area
• Payment is made by credit card, PayPal, or SEPA transfer via our provider Stripe

7.3 Price Changes

εkto γamat SAS reserves the right to modify its prices. Any modification will be notified to the user at least 30 days before taking effect. The user may then cancel their subscription before the new prices apply.

7.4 Refund Policy

Subscriptions are not refundable. In case of cancellation, access to the service remains active until the end of the paid period. The Free plan allows testing the service without commitment.

8. Termination

8.1 Termination by User

The user may cancel their subscription at any time from their customer area. Cancellation takes effect at the end of the current billing period.

8.2 Termination by Publisher

εkto γamat SAS reserves the right to suspend or terminate access to the service in case of:

• Non-payment of amounts due after reminder
• Violation of these terms of use
• Fraudulent or abusive use of the service
• Cessation of Cookeaz activity (with 3 months notice)

8.3 Consequences of Termination

At the end of the subscription, the user may export their data for 30 days. After this period, data is deleted in accordance with our privacy policy.

9. Applicable Law and Jurisdiction

These legal notices and terms of use are governed by French law.

In case of dispute, the parties agree to seek an amicable solution. Failing agreement, the competent courts of Paris will have sole jurisdiction.

For consumers residing in the European Union, in accordance with consumer code provisions regarding amicable dispute resolution, the user may resort to a consumer mediation service.
